Terms and conditions
Effective from 28 September 2026
These Terms and Conditions (the "Terms") govern the use of the marketplace provided by Bidders Highway AB, corporate identity number 559296-2939 ("Bidders Highway" or "we"), enabling users to market, sell and/or buy motor vehicles online via Bidders Highway's website or app (the "Platform"), as well as the services provided by Bidders Highway in connection with the Platform.
These Terms apply to everyone who visits, registers on, or otherwise uses the Platform ("Users"), whether private individuals or businesses. These Terms apply to the User for as long as the User makes use of the Platform or Bidders Highway's services.
1. Definitions
Aftersales Period: the period that begins at the End of Auction and runs for 24 hours, during which the Seller may choose to accept a bid lower than the Reserve Price in order to achieve a Win.
Aftersale: a sale of a listed motor vehicle brokered through Bidders Highway after the Aftersales Period has expired, to a User who placed a bid in the Auction or to another User.
Auction: the bidding process for a motor vehicle conducted via the Platform on the basis of an Auction Listing and running until the End of Auction.
Auction Listing: a listing published on the Platform by a Seller with information about a specific motor vehicle offered as an auction item for the purpose of marketing and selling the vehicle.
Auction Result: the result of an Auction at the End of Auction, including whether a Win has been achieved and, where applicable, the highest bid and the identity of the winning Buyer.
Buyer: a private individual or business that registers in order to place bids and acquire motor vehicles via the Platform.
Buyer's Fee: a fee of 7.5 % (incl. VAT) of a winning bid, payable by the Buyer to Bidders Highway upon a Win. The Buyer's Fee is at least SEK 5,000 and at most SEK 75,000.
Consumer: a private individual who, as a Buyer or Seller on the Platform, uses Bidders Highway's Platform Service for Buyers or Platform Service for Sellers.
End of Auction: the point at which an Auction either (i) results in a Win, or (ii) ends at the closing time stated in the Auction Listing without a Win having occurred.
Fee: collective term for the fees Bidders Highway charges for providing our services, including the Listing Fee, the Buyer's Fee and the Seller's Fee.
Listing Fee: a fixed fee of SEK 2,995 (incl. VAT) for work before the Auction begins (including valuation, preparation of listing text and layout, booking and/or carrying out professional photography and setting up the Auction Listing), payable by the Seller to Bidders Highway.
No reserve: an Auction Listing without a Reserve Price.
Platform Service for Buyers: the digital bidding and brokerage service Bidders Highway provides to Buyers, including bid handling and presentation of the Auction Result. Upon a Win, Bidders Highway then provides the Seller's contact details to the Buyer once the Buyer's Fee has been paid.
Platform Service for Sellers: the service Bidders Highway provides to the Seller, consisting of listing a motor vehicle for auction on the Platform (including valuation, preparation of listing text and layout, booking and/or carrying out professional photography and setting up the Auction Listing).
Purchase Agreement: an agreement between Buyer and Seller for the acquisition of a motor vehicle offered through an Auction Listing on the Platform.
Reserve Price: the lowest price the Seller has set in advance as acceptable consideration for a listed motor vehicle, below which the Seller is not obliged to enter into a Purchase Agreement or complete the Transaction.
Seller: a private individual or business that registers on the Platform in order to market and sell motor vehicles via the Platform.
Seller's Fee: a fee of 2.5 % (incl. VAT) of the final price, i.e. the winning bid, payable by the Seller to Bidders Highway upon a Win, subject to a minimum of SEK 2,500. No Seller's Fee is charged for Auction Listings without a Reserve Price.
Transaction: the Buyer's acquisition of a motor vehicle from the Seller following a Win.
Win: the situation where the Auction ends with the highest bid being accepted (End of Auction) because (i) the Reserve Price has been met or exceeded, (ii) the Seller, after the End of Auction and during the Aftersales Period, expressly accepts a bid below the Reserve Price, (iii) an Auction Listing without a Reserve Price ends with at least one bid, or (iv) an Aftersale is agreed.
2. Requirements for using the Platform
2.1 All Users of the Platform must be at least 18 years old or have the written consent of a guardian. A User who registers a legal entity certifies that they are authorised to bind that legal entity. By registering on the Platform, the User confirms that they accept the Terms and have read the referenced policies.
2.2 Bidders Highway reserves the right to refuse to provide the Platform to Users who breach, or have previously breached, these Terms, referenced policies or applicable laws and regulations.
3. Scope of Bidders Highway's role
Bidders Highway is not an auctioneer in the traditional sense and does not inspect motor vehicles marketed via the Platform. Bidders Highway gives no warranties regarding the listed vehicles (including, but not limited to, their existence, quality, safety, legality or ownership). Bidders Highway does not own the listed items, does not set prices and adds no terms to the Purchase Agreement. Bidders Highway is not a party to the Transaction or the Purchase Agreement, does not decide on withdrawal, return or complaints concerning the goods, and does not resolve disputes on the merits.
4. Time of performance of the Platform Services
The Platform Service for Sellers is deemed performed by Bidders Highway as soon as the Auction Listing has been published on the Platform.
The Platform Service for Buyers is deemed performed by Bidders Highway at the End of Auction, when Bidders Highway has communicated the Auction Result. The Buyer's Fee is then earned and invoiced. Upon a Win, the Seller's contact details are provided to the Buyer, in order to complete the Transaction, once the Buyer's Fee has been paid.
5. Separate Purchase Agreement
5.1 The purchase of the motor vehicle itself is a separate Transaction entered into directly between Seller and Buyer under Swedish law. The rights and obligations of the parties to the Purchase Agreement follow mandatory Swedish law and the terms of the Purchase Agreement. The Purchase Agreement is based on the content of the Auction Listing and whatever else has been agreed between Buyer and Seller.
5.2 Both businesses and private individuals may list motor vehicles on the Platform. Different rules therefore apply to purchases between private individuals and purchases from businesses. For example, when a private individual acquires a motor vehicle via the Platform from another private individual, consumer protection laws do not apply, which means, among other things, that the Buyer as a starting point has no right of withdrawal, right of exchange or open purchase. Consumer protection laws and regulations do not apply to Purchase Agreements where:
(a) both Buyer and Seller are private individuals;
(b) both Buyer and Seller are businesses/legal entities; or
(c) the Buyer is a business/legal entity and the Seller is a private individual.
5.3 Purchase Agreements described in points (a) to (c) above are governed by the Swedish Sale of Goods Act (1990:931).
5.4 When a Buyer, as a private individual and mainly for purposes outside a business, acquires a motor vehicle from a Seller who is a business, the Purchase Agreement between Buyer and Seller is governed by applicable consumer protection legislation, such as the Swedish Distance and Off-Premises Contracts Act (2005:59) ("DAL"). All of the Buyer's rights under such consumer protection legislation, including the right of withdrawal, remedies for defects and claims for damages, must be asserted directly against the Seller. Bidders Highway is not a party to the Purchase Agreement and cannot be held liable for the Seller's obligations under it.
6. Seller's obligations
6.1 When a Seller registers on the Platform to list a motor vehicle, the Seller accepts these Terms and associated policies. The Seller is responsible for ensuring the accuracy of information and for rightful ownership of and full right of disposal over the vehicle. On request, the Seller must be able to present documents confirming this.
6.2 In the Auction Listing, the Seller must disclose all known faults, defects or damage and otherwise provide all relevant information required by applicable law. The Seller warrants that material (images, videos, texts etc.) does not infringe the rights of third parties.
6.3 From the start of performance of the Platform Service for Sellers, throughout the period the Auction Listing is active, and until 48 hours after the End of Auction, the vehicle may not be offered in any way other than via the Platform (Bidders Highway has exclusivity).
7. Buyer's obligations
When a Buyer registers on the Platform to buy motor vehicles, the Buyer accepts these Terms and associated policies. The Buyer must read all information the Seller has provided in the Auction Listing before placing a bid. The Buyer is responsible for their own examination of the vehicle and for asking all necessary questions before placing a bid. Bidders Highway encourages Buyers, before bidding, to take all reasonable steps to examine a vehicle. This includes asking questions in the comment field of the Auction Listing and, where possible, agreeing with the Seller to inspect the vehicle in person. The Buyer is responsible for placing bids with the profile to which the Buyer's Fee is to be invoiced.
8. Special terms for Consumers
8.1 This section 8 applies only to Consumers as defined in these Terms and governs Consumers' use of the Platform, the Platform Service for Buyers and the Platform Service for Sellers. Bidders Highway never becomes a party to the Purchase Agreement between Seller and Consumer.
8.2 Bidders Highway provides the Platform, the Platform Service for Buyers and the Platform Service for Sellers as a business, which means Consumers enjoy certain consumer protection under applicable laws and regulations, including provisions on complaints and the right of withdrawal.
8.3 Under DAL, Consumers generally have the right to withdraw from contracts concluded online without giving any reason within 14 days. The withdrawal period expires 14 days after the contract is concluded. Note, however, that in order to use our services, Consumers must accept that the right of withdrawal ends as soon as we have performed the service in question. The same applies to any partial or additional services. See clarifications on when the right of withdrawal ends in sections 8.4–8.5 below.
8.4 When the Consumer places a bid on an Auction Listing, the Consumer agrees that Bidders Highway begins providing the Platform Service for Buyers. The Platform Service for Buyers is deemed performed when the Consumer places a bid on an Auction Listing. If the Consumer's bid does not lead to a Win, Bidders Highway charges no Buyer's Fee. Once the Platform Service for Buyers has been performed by Bidders Highway, there is no longer any right of withdrawal for the service under DAL.
8.5 When the Consumer initiates publication of an Auction Listing on the Platform (after a conversation with one of our handlers, when the Seller confirms the assignment), the Consumer agrees that Bidders Highway begins providing the Platform Service for Sellers. By confirming the assignment, the Consumer requests that Bidders Highway begins performing the service immediately. The Platform Service for Sellers is deemed fully performed when the Consumer's Auction Listing has been published on the Platform. Once the Platform Service for Sellers has been performed by Bidders Highway, there is no longer any right of withdrawal for the service under DAL.
8.6 In the Auction Listing, Bidders Highway will inform Consumers of:
(a) whether the Seller of a listed item is a business or not; and
(b) depending on whether the Seller is a business, whether DAL and consumer protection laws apply to the purchase.
8.7 A Seller who exercises the right of withdrawal before the vehicle has been photographed will be refunded the Listing Fee in full. Once the photography has been carried out, the Listing Fee is not refunded, as it then corresponds to the value of the services performed at the Seller's request.
9. Binding nature of bids and Win
9.1 All bids placed on the Platform are binding. Bids cannot be withdrawn during an ongoing Auction or the Aftersales Period. This is required to maintain fair and predictable bidding. Bidders Highway reserves the right to cancel or adjust bidding in cases of obvious error or system failure.
9.2 For Auction Listings with a Reserve Price, a bid must be equal to or greater than the Reserve Price to achieve a Win. The Seller is free to lower the Reserve Price or to accept a bid below the Reserve Price afterwards (during the Aftersales Period). If the Reserve Price is not met and the Seller does not expressly accept a lower bid, no Win occurs and no Buyer's Fee is charged. For Auction Listings without a Reserve Price, a Win occurs when the Auction ends with at least one bid.
9.3 At the End of Auction, Bidders Highway communicates the Auction Result. Upon a Win, Bidders Highway provides the Seller's contact details to the Buyer once the Buyer's Fee has been paid. Bidders Highway does not take part in drawing up contracts and is not responsible for the process after the End of Auction, except as provided in these Terms.
9.4 If no Win is achieved during the regular Auction period, the Aftersales Period begins, during which the Seller is free to accept bids placed during the Auction that did not meet the Reserve Price. Bidders Highway continues to facilitate communication between Buyer and Seller during the Aftersales Period.
9.5 After the Aftersales Period, Bidders Highway may, if the Seller so wishes, continue to broker the vehicle. A sale made through such brokering constitutes an Aftersale and a Win, and Fees are charged in the same way as for an Auction. Once the exclusivity under section 6.3 has ended, the Seller is free to sell the vehicle by other means, in which case no Fees are charged.
10. Subsidy of Bidders Highway's Fee
Bidders Highway may at its own discretion fully or partly subsidise its own Fee to help an Auction lead to a Win. This is an internal price adjustment of our platform fee and does not affect the purchase price, ownership or the contractual relationship between Buyer and Seller. Bidders Highway does not become a party to the Purchase Agreement.
11. Fees and payment
11.1 Buyer's Fee
The Buyer pays a Buyer's Fee of 7.5 % (incl. VAT) of the winning bid. The Buyer's Fee is at least SEK 5,000 and at most SEK 75,000.
The Buyer's Fee is charged only upon a Win. No Buyer's Fee is charged if the Reserve Price is not met and the Seller does not accept a lower bid.
The Buyer's Fee is invoiced without delay upon a Win and is payable within three days of the invoice date. The Seller's contact details are provided to the Buyer once the Buyer's Fee has been paid. The Buyer is clearly informed of the payment obligation.
If Bidders Highway cannot by law claim the Buyer's Fee from the Buyer after a Win, for example when a Consumer has exercised the statutory right of withdrawal, or when the Buyer does not wish to complete the Transaction due to circumstances on the Seller's side, such as the vehicle not matching the information provided by the Seller, the Seller is instead obliged to pay the Buyer's Fee to Bidders Highway.
If the Seller breaches Bidders Highway's exclusivity and markets the vehicle contrary to section 6.3, the Seller is obliged to pay the Buyer's Fee to Bidders Highway.
11.2 Listing Fee
The Seller pays a Listing Fee of SEK 2,995 (incl. VAT) for an Auction Listing before the Auction begins. The Listing Fee covers professional photography and administrative steps before publication of the Auction Listing (valuation, listing production, layout, booking/carrying out photography, setup).
The Listing Fee is invoiced when the Seller has confirmed the assignment and is payable within three days of the invoice date. Photography is booked once the fee has been paid. The Seller may cancel the assignment free of charge until the photography has been carried out. After that, the Listing Fee is not refunded.
If Bidders Highway for its own reasons decides not to publish the listing, and this is not due to the Seller, the Listing Fee is refunded to the Seller.
11.3 Seller's Fee
For Auction Listings published from 28 September 2026, a Seller's Fee of 2.5 % (incl. VAT) of the final price applies upon a Win, subject to a minimum of SEK 2,500. No Seller's Fee is charged for Auction Listings without a Reserve Price. The Seller's Fee is invoiced upon a Win and is payable within three days of the invoice date.
For Auction Listings published from 1 February 2026 to 27 September 2026, a Seller's Fee of 2.5 % (incl. VAT) applies without a minimum. Auction Listings published up to and including 31 January 2026 are not subject to a Seller's Fee.
11.4 Payment method and late payment
Fees are invoiced according to the details the User has registered in their profile. For the Buyer's Fee, the details of the profile with which the winning bid was placed apply. The User is responsible for ensuring the details are correct and complete.
Bidders Highway does not reissue an invoice after the fact to a recipient other than the registered one, such as a company, another person or another address. If the User wishes the invoice to be issued to a legal entity, bids or sales must be made through a profile registered to that legal entity.
Statutory late-payment interest applies.
12. Content on the Platform
12.1 Exchange offers are not permitted in the comment field on the Platform. Bidders Highway may refuse, cancel or subsequently withdraw publication of irrelevant or prohibited content.
12.2 The Seller is responsible for holding the necessary rights to material and content published on the Platform and grants Bidders Highway an unlimited right to edit, adapt, store, copy and make the material and content available to the public, including via partners. These rights remain after a completed or cancelled Auction.
12.3 Bidders Highway obtains full rights of use to any intellectual property rights in material and content published on the Platform. Material may not be used outside normal use of the Platform.
12.4 The Seller consents to external publication for marketing purposes (e.g. mobile.de/Blocket).
13. Suspension of Users
13.1 Misuse of the Platform
Bidders Highway may block or suspend a User who misuses, manipulates or uses the Platform in breach of the Terms, referenced policies or applicable law (e.g. sale of goods and intellectual property legislation, anti-money laundering rules, marketing legislation).
13.2 Payment-related restrictions
In the event of an unpaid invoice (e.g. for Fees), Bidders Highway may temporarily restrict the User's access to certain functions – including the ability to place new bids and/or publish new Auction Listings – until full payment has been registered. Such restrictions do not affect bids already placed or the parties' existing contractual obligations.
14. Liability and limitation of liability
Bidders Highway does not guarantee continuous, uninterrupted or secure access to the Platform. Bidders Highway is not liable for damage caused directly or indirectly by the use of the Platform or its content. The Platform is solely a marketplace that brings together Sellers and Buyers of motor vehicles.
15. Changes to terms, services and prices
Bidders Highway may change terms, services and prices at its own discretion. Users will be informed by Bidders Highway in accordance with applicable law. Users have the right to terminate their existing agreement with Bidders Highway before the changes take effect. The effective date of the new terms is clearly stated in the notice from Bidders Highway.
15.1 Business users (P2B)
In the event of changes to these Terms, applicable policies, services or prices, we inform the User at least 15 days in advance (or longer if technical adaptation is required). Users have the right to terminate before the change takes effect.
15.2 Consumers
In the event of significant changes to these Terms, applicable policies, services or prices, the Consumer is informed in advance (e.g. by email and at the next login to the Platform), with as much notice as possible. Where advance notice is not possible, Bidders Highway will inform the Consumer as soon as possible. By continuing to use the Platform after the new terms have taken effect or after receiving notice of the changes (whichever occurs later), the Consumer is deemed, to the extent permitted, to have accepted the new terms.
16. Ranking criteria for Auction Listings
Auction Listings on the Platform are primarily presented based on the time remaining until the End of Auction – that is, auctions ending soon are shown first. This time factor is the main criterion determining the order in which listings are shown to the User.
The Platform also offers free-text search, allowing the User to search auctions using their own words and terms. This search function affects which listings are shown based on the occurrence of search terms in titles and descriptions, but does not otherwise affect the ranking, which continues to be governed by time remaining until the End of Auction.
At present there is no other form of ranking, such as prioritisation based on popularity, price, user reviews or paid advertising. We do not accept payment from Sellers to influence a listing's placement.
In exceptional cases, Bidders Highway may choose to highlight certain items in specific editorial contexts, such as selected collection auctions or articles. Such editorial highlights are made manually and are not part of the automated ranking system.
17. Governing law and disputes
These Terms are governed by Swedish substantive law. Disputes are settled by the Stockholm District Court as the court of first instance. In the event of any conflict between the Swedish version and an English-language version of these Terms, the Swedish version prevails.
